Welcome to Profit Pedal, Inc. (“Profit Pedal,” “we,” “our,” or “us”). By accessing or using our website https://profitpedal.com or engaging with our services, you agree to these Terms and Conditions. Please read them carefully.

1. Use of Our Website and Services

You agree to use our website and services only for lawful purposes and in accordance with these Terms.
You may not use our website or services in any way that could damage, disable, overburden, or impair them, or interfere with others’ use.

2. Intellectual Property

All content, trademarks, logos, designs, text, graphics, and software on our website are owned by or licensed to Profit Pedal and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

3. Payment Terms

Payments are processed securely through Stripe.
All fees are due as stated at the time of purchase or as outlined in a separate agreement.
You are responsible for ensuring accurate billing information and timely payment.

4. Project-Specific Terms

Guarantee

If we miss a milestone and you have met your responsibilities, we will complete that milestone at no further cost within 10 business days. If it is still not met after that extension, you may stop the engagement, receive a pro rata refund of any prepaid, unused fees, and keep all completed work and IP.

Acceptance Window

You have 7 business days from delivery to request changes. We iterate within scope until acceptance.

Your Responsibilities

A decision-maker attends the weekly session.
Required analytics and billing access are provided.
Approvals or feedback are given within 48 hours.

Dependencies and Change Control

Timelines and acceptance windows pause if required inputs or access are delayed.
Work beyond the Statement of Work (SOW) requires a written change order with updated timelines and budgets.

Confidentiality and Access

Mutual NDA applies by default. We do not share client names or logos, and case studies are anonymized.
Access is limited to what we need to deliver. All access is removed and files are returned or deleted within 24 hours of project close.

Commercial Details

90-Day Growth Sprint payments: 50 percent to start, 25 percent at day 30, 25 percent at day 60.
Sprint prepay: 10 percent discount if paid upfront (total $18,900).
Diagnostic credit: Start the 90-Day Growth Sprint within 30 days of the 2-Week Funnel Diagnostic and receive a $1,500 credit.
Retainer term: Initial term 90 days, then month-to-month with 30-day notice.
Delivery overages: Pre-approved via a simple rate card.
Budgets and tools: Media budgets and SaaS tools are your costs.
Enterprise note: Enterprise or regulated environments may include a 15 to 25 percent uplift for security reviews, governance, and additional stakeholder management.
Pricing guardrails: The only discounts are the 10 percent Sprint prepay and the $1,500 Diagnostic credit. If budget is tight, choose a lower tier rather than requesting a custom discount.

5. No Guarantees or Warranties

While we strive to provide accurate and reliable information, our website and services are provided “as is” without warranties of any kind.
We do not guarantee that use of our services will lead to specific business results or outcomes.

6. Limitation of Liability

To the maximum extent permitted by law, Profit Pedal is not liable for any direct, indirect, incidental, or consequential damages arising out of your use of our website or services.
Our total liability to you for any claims related to our services shall not exceed the fees paid by you to us in the 12 months preceding the claim.

7. Third-Party Links

Our website may include links to third-party websites or services. We are not responsible for the content, policies, or practices of those third parties.

8. Termination

We reserve the right to suspend or terminate your access to our website or services if you violate these Terms or misuse our resources.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Brevard County, Florida.

We may update these Terms from time to time. Changes will be effective immediately when posted on this page, with an updated “Last updated” date.
